Section 106

* A signaller shall be a competent worker & shall not perform other work while acting as a signaller.

* The signaller shall wear a garment that covers at least his or her upper body complies with the regulations.

* A signaller must receive oral & written instruction. A signaller shall,

(a) be clear of the intended path of travel of the vehicle, machine or equipment;

(b) be in full view of the operator of the vehicle, machine or equipment;

(c) have a clear view of the intended path of travel of the vehicle, machine or equipment, or its load; and

(d) watch the part of the vehicle, machine or equipment or its load whose path of travel the operator cannot see.

An excavator operator was dumping a log into a grinder when a scream was heard.  The excavator had reversed the machine & ran over the grinder operator.
The company was charged for failing to establish an adequate system of communication between workers.
