Section 96

(1) No worker shall operate a vehicle at a project unless he or she is competent to do so.

(2) However, a worker being trained in the operation of a vehicle may operate it while being instructed and supervised by a competent person.

“Competent person” means a person who,

– is qualified because of knowledge, training and experience to organize the work and its performance.

– is familiar with this Act and the regulations that apply to the work, and

– has knowledge of any potential or actual danger to health or safety in the workplace;

Worker fined $15,000 for running over and killing a co-worker at a London garbage- handling facility.
The deceased was acting as a spotter for the operator of a front-end loader. The operator was charged for operating equipment in an unsafe way.  Fellow workers described the operator’s driving habits as “rammy”, “reckless”, and “always in a rush”.
The employer Canadian Waste Management Systems Inc., was fined $300,000.
